Summary of Pennsylvania DUI Penalties

In Pennsylvania, the penalties imposed for a DUI offenses depend on the person’s blood alcohol content level and the number of prior alcohol related offenses.

General Impairment (BAC .08 - .10)

1st Offense General Impairment

Jail: Generally no jail time, but mandatory six (6) months probation.
Fines: $300.00
Other conditions: attendance at an approved alcohol highway safety school and compliance with all drug and alcohol treatment requirements, and up to one hundred and fifty (150) hours of community service.
2nd Offense General Impairment
Jail: Five (5) days to six (6) months
Fines: $300.00 to $2,500.00
Other conditions: License Suspension of one (1) year. Ignition Interlock for one (1) year. Attendance at an approved alcohol highway safety school and compliance with all drug and alcohol treatment requirements. Up to one hundred and fifty (150) hours of community service.

3rd Offense General Impairment

Jail: Ten (10) days to 2 years imprisonment.
Fines: $500.00 to $5,000.00
Other conditions: License Suspension of one (1) year. Ignition Interlock for one (1) year. Attendance at an approved alcohol highway safety school and compliance with all drug and alcohol treatment requirements. Up to one hundred and fifty (150) hours of community service.

High Rate of Blood Alcohol (BAC .10 - .159)

1st Offense High BAC

Jail: Forty eight hours (48) to six (6) months.
Fines: $500.00 to $5,000.00
Other conditions: License Suspension of one (1) year. Ignition Interlock for one (1) year. Attendance at an approved alcohol highway safety school and compliance with all drug and alcohol treatment requirements. Up to one hundred and fifty (150) hours of community service.

2nd Offense High BAC

Jail: Thirty (30) days to six (6) months.
Fines: $750.00 to $5,000.00
Other conditions: License Suspension of one (1) year. Attendance at an approved alcohol highway safety school and compliance with all drug and alcohol treatment requirements. Up to one hundred and fifty (150) hours of community service.

3rd Offense High BAC

Jail: Ninety (90) days to sixty (60) months.
Fines: $1,50.00 to $10,000.00
Other conditions: License Suspension of eighteen (18) months. Attendance at an approved alcohol highway safety school and compliance with all drug and alcohol treatment requirements. Up to one hundred and fifty (150) hours of community service.
4th or Subsequent Offense High BAC

Jail: Ninety (90) days to sixty (60) months.
Fines: $1,500.00 to $10,000.00

Highest Rate of Blood Alcohol (BAC .16 and higher)

Jail: Seventy two (72) hours to six (6) months. Fines: $1,000.00 to $5,000.00 Other conditions: License Suspension of one (1) year. Attendance at an approved alcohol highway safety school and compliance with all drug and alcohol treatment requirements. Up to one hundred and fifty (150) hours of community service.

2nd Offense Highest BAC

Jail: Seventy two (72) hours to six (6) months.
Fines: $1,500.00 to $10,000.00
Other conditions: License Suspension of eighteen (18) months. One (1) year mandatory ignition interlock device. Attendance at an approved alcohol highway safety school and compliance with all drug and alcohol treatment requirements. Up to one hundred and fifty (150) hours of community service.

Fines: $2,500.00 to $10,000.00
